TERMS AND CONDITIONS
1. INTRODUCTION
These Terms and Conditions ("Terms") govern your participation in the "Project Scroll Control" video contest ("Contest") organized by ISAC Foundation ("Foundation," "we," "us," or "our"), an international non-profit foundation, in collaboration with CERT-IN and supported by Global Tipping Point Summit.
By submitting a video to the Contest, you ("Participant," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please refrain from participating in the Contest.
2. ELIGIBILITY
The Contest is open to:
School students under 16 years
College students over 16 years
Professionals, companies, and individual influencers
Employees, officers, directors of the Foundation, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members of such individuals are not eligible to participate.
3. SUBMISSION REQUIREMENTS
3.1. All submissions must:
Be original content created by the Participant
Be between 30 seconds and 2.5 minutes in duration
Adhere to the theme of cybersecurity awareness
Be in one of the approved languages listed in the Contest guidelines
Not contain any copyrighted material without proper authorization
Not violate any third-party rights
Comply with all applicable laws and regulations
3.2. By submitting a video, you represent and warrant that:
You are the sole owner of all rights in the submitted video
You have obtained all necessary permissions from any individuals appearing in your video
Your submission does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
For participants under 18 years of age, you have obtained parental or legal guardian consent
4. INTELLECTUAL PROPERTY RIGHTS AND LICENSE GRANT
4.1. Ownership: While you retain ownership of the copyright in your original submission, by submitting a video to the Contest, you irrevocably grant to the Foundation the following rights:
4.2. License Grant: You hereby grant to the Foundation and its affiliates, partners, and licensees a worldwide, perpetual, irrevocable, royalty-free, fully transferable, and sublicensable right and license to:
a) Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise exploit your submission, in whole or in part, in any media formats and through any media channels now known or hereafter developed, without any additional approval or consideration;
b) Use your name, likeness, voice, photograph, and biographical information in connection with your submission for promotional, marketing, or any other purposes;
c) Edit, modify, crop, or arrange the submission as the Foundation deems appropriate;
d) Add the Foundation's logo, branding elements, or other content to the submission;
e) Incorporate the submission into other works or compile it with other submissions;
f) Monetize the submission through any and all means, including but not limited to: inclusion in paid educational materials, licensing to third parties, inclusion in learning management systems, use in fundraising activities, and commercial distribution through any channel;
g) Use the submission for any purpose whatsoever, including promotional, educational, commercial, or non-commercial purposes, without any compensation to you.
4.3. Waiver: To the extent permitted by applicable law, you hereby waive any "moral rights" or similar rights you may have in your submission, including but not limited to the right to be identified as the author and the right to object to derogatory treatment of your submission.
4.4. Duration and Territory: The rights granted herein shall continue indefinitely and extend to all territories worldwide.
4.5. No Obligation to Use: The Foundation shall have no obligation to use or display any submission.
5. SELECTION OF WINNERS
5.1. The Foundation will select winners based on criteria including:
Creativity and originality
Effectiveness in communicating cybersecurity awareness
Quality of production
Adherence to Contest theme and guidelines
5.2. All decisions made by the Foundation regarding winner selection are final and binding.
5.3. The Foundation reserves the right to disqualify any Participant who violates these Terms or engages in any fraudulent activity in connection with the Contest.
6. PRIZES
6.1. Prizes will be awarded to the winners as described in the Contest guidelines.
6.2. Prize acceptance constitutes permission for the Foundation to use the winner's name, likeness, and submission for advertising and promotional purposes without additional compensation.
6.3. All federal, state, and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner.
7. LIMITATION OF LIABILITY
7.1. By participating in the Contest, you agree to release, discharge, indemnify, and hold harmless the Foundation, CERT-IN, Global Tipping Point Summit, and their respective officers, directors, employees, representatives, agents, successors, and assigns from and against any claims, damages, liability, losses, costs, or expenses of any kind arising out of or relating to your participation in the Contest, your submission, or your acceptance, possession, use, or misuse of any prize.
7.2. The Foundation assumes no responsibility for:
Any technical failures related to the submission process
Unauthorized human intervention in any part of the Contest
Technical or human error that may occur in the administration of the Contest
Any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from your participation in the Contest
8. REPRESENTATIONS AND WARRANTIES
By submitting a video to the Contest, you represent and warrant that:
8.1. You have the full right, power, and authority to enter into this agreement and to grant all rights specified in these Terms.
8.2. Your submission is your own original work and does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
8.3. You have obtained all necessary permissions, releases, and consents from all persons appearing in the submission.
8.4. Your submission does not contain any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
8.5. You are not subject to any obligations or restrictions that would prevent you from granting the rights provided in these Terms.
9. CONFIDENTIALITY
The Foundation will maintain the confidentiality of your personal information in accordance with its Privacy Policy and applicable laws. However, by participating in the Contest, you acknowledge and agree that your submission may be made publicly available by the Foundation.
10. MODIFICATION OR CANCELLATION
The Foundation reserves the right, in its sole discretion, to modify, suspend, or terminate the Contest, or any part of it, if the Contest cannot be conducted as planned due to any reason beyond its control, including but not limited to technical failures, unauthorized intervention, fraud, or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest.
11. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.
12. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
13. CONSENT FOR MINORS
13.1. If you are under 18 years of age, you must obtain the consent of your parent or legal guardian before participating in the Contest.
13.2. By allowing a minor to participate in the Contest, the parent or legal guardian agrees to these Terms on behalf of the minor and takes full responsibility for the minor's submission and compliance with these Terms.
14. ASSIGNMENT
The Foundation may freely assign its rights and obligations under these Terms. You may not assign your rights or obligations under these Terms without the prior written consent of the Foundation.
15. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and the Foundation concerning the Contest and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
